New Horizons offers a free consultation service to help families plan their estates.  Estate planning is particularly important for families where one or more members has a developmental disability.  Leaving a portion of an estate to a trusted family member, with the intent that that portion will be used for the benefit the developmentally disabled individual, is not necessarily a safe way to provide for a loved one.  In such an arrangement, that portion of the estate intended for the disabled person becomes part of the estate of the trusted family member.  If the trusted custodian gets into financial difficulty or passes away, the disabled person will very likely be left with nothing!Day Training Activity Center Art Room

Also, probate expenses can considerably reduce the amount available for distribution. Therefore, probate should be avoided if possible.

A Special Needs Trust can assure that the portion of an estate set aside for a developmentally disabled family member will be available to that person throughout his/her lifetime. Properly drawn, such a trust will avoid probate and will not jeopardize federal/state funding furnished to the disabled individual.

A Special Needs Trust can be established as a free standing trust or as a trust within a Living Trust.  The free consultation service offered by New Horizons assists families in understanding options which are available in their planning for their loved ones.  The individuals who volunteer their time not only will assist with the planning process but can advise what to expect with respect to costs and procedures.  Referrals may be made to estate planning attorneys who are experts in this field.
